The Yamhill County Board of Commissioners opened a public hearing on Dec. 4 for docket C125, an appeal of the planning director's approval of a loss-mitigation business operating as a home occupation for M and H Oregon Construction LLC (applicant Javier C.). Lance, planning staff, recommended approval subject to 19 conditions that address on-site location, building occupancy and permits, erosion control, employee limits, hazardous-waste handling, driveway inspection, signage limits, lighting, prohibitions on outdoor amplified sound and outdoor equipment storage, parking requirements, screening/fencing and a required one-year review.
Planning staff explained the review process is typically complaint-driven and that the county has not previously had to revoke such permits in Lance's experience. Commissioners asked clarifying questions about how the one-year review is conducted and whether newly planted screening would be acceptable while vegetation matures; staff said planting would be acceptable if the owner demonstrates progress toward compliance. After closing the hearing, the board moved to approve the application based on staff recommendations and voted unanimously to adopt the conditional-use permit and associated conditions.
The approval is valid for one year following final approval; staff indicated a review is required one year after final approval and renewal may be permitted if conditions are met.
