The Zoning Board granted a special exception for Dane LLC to operate a landscaper contractor’s storage yard on a 16‑acre parcel off Swan Lake Trail, after hearing legal argument, applicant testimony and substantial public comment.
Attorney Gary Bovair, representing Dane LLC, told the board the proposed use would be limited to storing midsize landscaping vehicles and equipment, not the heavy, high‑impact operation typically associated with contractor yards. "This is just a simple, storage yard for a landscaper with midsize vehicles and small landscaping equipment," Bovair said, and he cited recent sales data for a nearby parcel to argue there was no demonstrable negative effect on property values.
Applicant Chris Johnson described long‑standing on‑site activity and said the operation would not include retail sales or extensive material stockpiling. He confirmed most heavy equipment is typically out on jobsites and said material brought to the yard is transient. Neighbors were split: several abutters and near neighbors testified in support, noting courteous drivers, minimal disturbance and community help provided by the applicant. Others raised concerns about traffic, safety (children in driveways), and the possibility that the business could expand over time.
Board members reviewed the special‑exception worksheet (Article 400, section 4.01.d.17), including site appropriateness, potential nuisance, and property‑value impact. The board entered conditions on the approval record—no retail sales from the site and operational hours guidance—and several members emphasized that a special‑exception approval does not automatically transfer to future owners without a new application.
The board voted to approve the special exception with conditions recorded in the minutes; members said the 16‑acre, well‑screened site and neighbors’ positive testimony weighed in favor of allowing the limited contractor storage use.
