The Town of Clinton Zoning Board of Appeals on Dec. 4 granted area variances that permit a deck at 807 Center Road to remain closer to property lines than the zoning code allows. The board approved a front-setback reduction from 100 feet to 94 feet and a left-side reduction from 50 feet to 43 feet.
Frank McMahon, summarizing the planning board record, said the applicants, Joshua Van Leuven and Sienna Barbot, applied under §250-98 D(1) for relief because a deck had been constructed within the required setbacks. McMahon told the board the side variance represented about a 14% reduction while the front variance was roughly 6% and that the planning board recommended approval at its Oct. 7 meeting.
Board members reviewed site visibility, existing screening and whether the parcel contained regulated wetlands; McMahon said the site does not contain a New York State DEC wetland and noted the application is a SEQR Type II action that requires no further environmental review. The board also discussed building inspection and railing requirements; the chair noted that anything above 30 inches requires a guardrail.
With no public opposition presented at the hearing, the board voted to grant the variances with the condition that outstanding publication fees be paid. Chair Joseph Malcarney announced the motion carried and the variances were granted.
The board record notes the applicant paid the application fee and that no known zoning violations were associated with the property at the time of the vote. The decision does not require additional SEQR review per the board's finding.
The ZBA will file the written determination and any conditions in the town clerk's office; no additional procedural steps were announced at the meeting.
