The Coffey County Board of Commissioners approved a special use permit and Resolution Number 2025963 on a 200-foot wireless communications facility for county emergency communications during a public hearing held Nov. 17.
Zoning Administrator Heidi Harris told the board the planning board reviewed her Nov. 5 report, "made their 17 findings of facts" and issued "a recommendation for approval with the following condition attached to it," including a provision that the tower's use and operation be part of the county's emergency services and that the permit become null and void if the facility ceases operation for that purpose. Andrew Vega, the applicant's agent contracted by Eaton Towers/SSC for site acquisition and permitting, said he had "nothing new to add" beyond what was presented to the planning board.
After outlining the governing body's options under state statute, a commissioner moved to adopt the planning board's findings and approve the permit; the motion was seconded and approved by voice vote. The chair noted that persons "aggrieved by the final decision" have 30 days after the resolution is published to appeal to district court.
The planning board's recommendation, the applicant's representations and the commission's approval complete the governing-body step required under county zoning procedures; the resolution ties the use to county emergency services and establishes the administrative record for any subsequent appeal.
The commission closed the public hearing later in the morning and moved on to other agenda items. No roll-call vote sheet or individual yes/no tallies were recorded in the meeting transcript; approval was recorded by voice vote with "aye" responses.
