The Nevada Gaming Control Board on Dec. 11 recommended a package of amendments to NGC Regulation 5 that govern "club venues" such as pool cabanas and other semi‑private gaming areas.
Senior Deputy Attorney General Ed McGaw outlined a workshop draft (dated Dec. 4, 2025) that standardizes terminology, lists qualifying offerings for a club venue, aligns waiver language with standard provisions, and adds a new Reg. 5.35 requiring licensees to notify the board of club‑venue openings, ownership changes and closures. McGaw said the chair would retain authority to waive or modify timelines in appropriate cases.
Chief of Enforcement Torgerson told the board the proposed notification provision is intended to improve transparency and give staff timely awareness of new venues so agents can confirm surveillance and employee registration. "We are definitely maintaining some flexibility with club venues," she said, adding that the goal is to make the regulatory language track NRS 463.0144 and practical enforcement needs.
Member Sandahl moved that the board recommend the draft incorporating on‑the‑record changes; the board voted unanimously (Assad — Aye; Sandahl — Aye; Dreitzer — Aye) to transmit the recommendation to the Nevada Gaming Commission for its consideration.
The draft will proceed to the Commission, which will determine final adoption and any effective date.
