The Cocoa City Council voted Dec. 9 to adopt a first addendum correcting the city’s solid-waste franchise agreement with Waste Management of Florida to remove two commercial-service provisions that staff said were added to the previous agenda in error.

City staff described the change as a scrivener’s error: the exhibit attached to the prior ordinance did not reflect the commercial service rates the council had actually approved. Staff said Waste Management did not begin charging the higher, incorrect commercial rates until November and that the company provided a credit for the period charged at the incorrect rates. The amendment updates Exhibit A to reflect the intended commercial rates and removes the two unauthorized agenda items.

City staff read the ordinance by title and opened the item for public comment; there were no public speakers on the ordinance. Council asked clarifying questions and then approved the addendum unanimously.

What’s next: The corrected exhibit will be incorporated into the franchise agreement and city records. Staff said this action simply aligns the contract documents with the council’s prior approval.
