At the close of its Nov. 20 meeting Crow Wing County staff previewed the Dec. 18 Planning Commission meeting and an appeal hearing that will address whether a plat remnant in Jenkins Township (Block 2) is buildable. Staff said the appeal will center on two legal criteria drawn from Minnesota statute 3 94 and county ordinance 8.7: whether the staff decision was arbitrary and capricious, and whether the decision failed to conform with the ordinance.

Staff described the procedural steps: a brief from the appealing party and a staff memo in response, published notice and a public hearing where the attorney and possibly the property owner will present argument; the board will deliberate and issue findings. Staff noted published notice is required but mailed notices are not. The board was also told that the Planning Commission’s on‑site visits are scheduled for Dec. 4.

Staff emphasized that the record and findings of fact are central to appeals and that the board should expect legal briefs and a staff memo to prepare for the hearing.
