The Overland Park City Council unanimously approved two resolutions Jan. 27 that clear the way for a partial sale of the Glenwood Commons development at 91st Street and Metcalf Avenue and amend the existing development agreement to allow shared ownership interests.
Todd Habesala, a staff presenter, told the council the matters before it involved the Glenwood Commons project and a buyer-vetted assignment of a portion of the site. "This entire ... these matters are about, the Glenwood Commons project that's at 91st and Metcalf," Habesala said, adding the transaction concerns "a relatively small, about a $1,700,000 CID project that has long since been completed." He said the sale would include the right to collect the remainder of the CID proceeds.
The second measure the council approved was a fourth amendment to the site's development agreement that, as Habesala described it, would permit the buyer to sell percentage (undivided) interests in the property under defined restrictions. "It essentially means that you can sell percentage interests ... and it allows them to sort of right size their investment in the property," Habesala said. The amendment includes parameters the city required to ensure the vetted developer retains primary ownership percentage and operational control as declarant, including management and easement authority.
Why it matters: the council's action transfers the developer's contractual rights for a portion of Glenwood Commons to a new party and modifies the city's agreement to accommodate a common-interest/tenancy structure and ownership transfers while preserving city oversight and control provisions outlined in the amendment.

City Manager Lori Curtis Luther used her report to announce summer pool plans and staffing: "We will be opening Stonegate, Young's and Tomahawk Ridge Aquatic Center for the season on May 25th," she said, and noted lifeguard hiring has begun with training to occur in March; applicants must be at least 15 years old by May 1 and early applicants get location preference.
Public comment: one person had signed up but chose not to speak. Committee reports noted a public works committee meeting scheduled to discuss the department's response to the Jan. 5 storm; the director will review operations, successes and challenges and start discussions on possible operational changes.
