Special Magistrate Jennifer De Peschke continued a Massey fine hearing for the property at 3005 Dunbar Street on April 2 and suspended further accrual of fines for 90 days while the property owner pursues repairs.
Charmaine Kirkland, parking and code enforcement officer, and other staff presented the case history: the matter originated March 7, 2024, with IPMC and nuisance violations (roofs/drainage, protective treatment, outside storage). A prior special magistrate in June 2024 found violations existed and gave 60 days to comply; an affidavit of noncompliance was later issued and fines began accruing. City staff reported the fine balance had been stopped on Nov. 19, 2024, with the recorded balance at $20,500.
Lorenzo Jones (who identified himself in the record) said some work had been done (trim and pressure washing on the first level; some trim on the second level remained). He said limited funds and disability income constrained his ability to complete repairs quickly; he described purchasing some materials and pausing work when funds ran out.
The magistrate explained that a Massey hearing considers the gravity of the violation, remedial actions taken and prior violations in deciding whether to reduce fines. Because the property was not yet fully in compliance, the magistrate indicated the city typically does not recommend a fine reduction without compliance.
City staff and the magistrate discussed an appropriate timeline. The city indicated 90 days would be acceptable; the magistrate continued the Massey hearing for 90 days, suspended further accrual of fines for that period (the balance remains $20,500 as of Nov. 19, 2024) and instructed the owner to stay in touch with staff and obtain estimates and contractors as needed. The magistrate said a future hearing may consider a fine reduction after the property is brought into compliance and reinspected.
The order preserves the existing balance but halts daily fines for the 90-day continuance and sets expectations for communication with city staff and reinspection.
