The Nevada Assembly Committee on Revenue voted in a work session to advance Senate Bill 41, which would require businesses selling cannabis to obtain a tax or cannabis tax permit from the Department of Taxation in addition to any other permit required by law.
The bill, sponsored by the Senate Committee on Revenue and Economic Development on behalf of the Department of Taxation, was presented to the committee by Michael Nakamoto of the fiscal analysis division. Nakamoto told the panel that SB41 "requires that a tax or cannabis tax permit be obtained from the Department of Taxation by any business wishing to engage in the sale of cannabis in Nevada." He also said the permit requirement would apply to any licensee of the Cannabis Compliance Board engaged in retail sales.
Committee members did not propose amendments during the work session. Vice Chair Constantine moved to do pass the bill, seconded by Assembly member Wynne. Assembly member Gallant said he would "vote yes out of the committee, but reserve my right to vote no on the floor." The committee recorded no votes from Assembly members Hafen, Gray and O'Neil; the motion carried. Chair Backus assigned the floor statement to herself.
The measure would add an additional permit requirement for cannabis retailers; the fiscal analysis summary attached to the work session document did not propose changes to existing licensing requirements beyond the new tax-permit obligation. The committee opened the floor for questions about the work session documents but none were raised before the motion to advance the bill.
The committee opened public comment after the three bills on the agenda and recorded no callers or in-person speakers during this meeting.
