The West Lafayette Common Council voted unanimously on Sept. 2 to adopt an amended ordinance (Ordinance 38-20-25 as amended) to vacate portions of County Road North 100 West after a brief public hearing and discussion.
Ryan Munden of RTS Law, representing BC West Lafayette Land Holdings, explained during the public hearing that the petitioner had amended its legal description after filing to include the full width of the right-of-way the petition seeks to vacate. Munden said the petitioner had received approval from the Tippecanoe County Commissioners on second reading earlier that day for the related county action and that the city portion of the road is being vacated as housekeeping tied to the Yeager Road extension and a planned Roundtable extension. He said part of the right-of-way would be left in place to preserve access to the Faust property.
Councilors moved and seconded opening the public hearing; no other members of the public spoke in opposition. After closing the hearing, the clerk called the roll. The council recorded nine yeas and no nays; the mayor announced, "That means, ordinance 38 20 25 as amended has passed."
The petitioner noted that a petition for disannexation of the north half of the right-of-way would be heard at the Board of Works the following Tuesday. The ordinance will be recorded and coordinated with county actions to complete the vacation and any subsequent property or access adjustments.
The council's action included an amendment by substitution adopted earlier in the meeting; the amendment was adopted by voice vote prior to the public hearing and the roll-call vote on final passage.
