The Dental Commission was notified that the Department of Public Health filed a notice withdrawing the statement of charges in the matter involving respondent Adita Topali and that the petition has been closed.
Attorney Fusino told the commission that when the consent‑order packet was submitted a statement of charges accompanied it and that the department has now filed a notice of withdrawal. "The statement of charges have been withdrawn. The, and the hygiene license has been the petition has been closed, by disciplining the hygiene license. So there's nothing for you to act upon today," Fusino said.
Chairman Katz and other commissioners said they had been surprised the item appeared on the commission's agenda because the commission does not currently exercise jurisdiction over dental hygiene licensing enforcement. Katz said members had previously discussed a fine and possible larger penalty but that the Department of Public Health is the disciplining entity: "The Department of Public Health has, disciplines the hygiene license. I believe at 1 time, the hygienists were under the jurisdiction of the Dental Commission, but that hasn't been the case for, a decade or more," Fusino said.
During the meeting the commission also considered two provisional license applications. Judith Bailey, licensed application analyst for dental licensing, told the commission that two provisional applications had been submitted for review and that supporting documents and examination results were in order. She identified the provisional intended licensees as Ignacio Velasquez and Harshev Karya and said the provisional licenses would allow them to work at UConn as faculty members.
The commission voted to accept the provisional applications. The motions passed by voice vote with no recorded opposition.

No monetary penalties, fines, or other sanctions were finalized before the commission because, according to attorney Fusino and subsequent discussion, the Department of Public Health handled discipline in the hygiene matter and the statement of charges was withdrawn. The transcript records that a $5,000 fine had been discussed earlier and that some commissioners had argued for a higher fine ("up to $10,000"), but the commission recorded that the disciplinary action and any sanctions were handled by the Department of Public Health and the current status of any fine was not specified in the commission record.
The commission adjourned and noted its next meeting is scheduled for Dec. 10 at 1 p.m.
