Morgan County Planning Commission members on Oct. 23 voted unanimously to recommend approval to the County Commission of a conditional use permit for a private gravel pit near 3100 North Lost Creek Road (CUP25.009), subject to engineering conditions and a requirement that revegetation plans be approved at reclamation.
Planning staff described the site as a 247.25-acre parcel split-zoned Rural Residential (RR-1) and Agriculture (A-20). Because the application is classified C3, the planning commission’s action is a recommendation to the County Commission. Staff said the county engineer and a second engineering reviewer provided drainage reviews; staff proposed including the engineers’ stipulations in the staff report forwarded to the County Commission.
The engineering stipulations read into the record include: a reclamation plan that provides topsoil, slope-stabilizing vegetation, pond removal and clarification of note 8 on the drawings; phasing or a statement that material removal will be done in a single phase; establishment of a reclamation bond before operations begin; county inspections before, during and after excavation; runoff-storage volume sized for at least the 25-year, 24-hour storm or the Utah Division of Oil, Gas and Mining minimum (whichever is greater); and drainage-direction arrows with a note directing runoff from the excavation to the stormwater retention area.
Property owner Leslie Harris and landowner/operator Mike Schultz (owner of Soma Ranch) were present. Schultz, who described native-seed choices for revegetation, said the seed mix will favor species that support wildlife but may include crested wheatgrass for slope performance. Commissioners added a condition that the applicant return to the commission for revegetation approval at the time of reclamation.
Residents raised traffic and safety questions for the narrow road serving the site. Commissioners discussed existing hours of operation that staff had included in the packet (7:00 a.m. to 5:30 p.m., Monday–Friday) and whether a speed limit could be required by stipulation. Staff and the county engineer advised that establishing or enforcing a new speed limit would require consultation with the county attorney and the county highway authority; commissioners agreed to forward the discussion to the County Commission and include the meeting minutes in the transmittal.
Member Sessions moved to recommend approval to the County Commission of CUP25.009, including conditions listed in the staff report dated Oct. 23, 2025, adding the engineering memo dated Oct. 22, 2025, and requiring the applicant to return for revegetation approval at reclamation. Member Wilson seconded; the motion carried unanimously.
Staff will include the engineering conditions in the report to the County Commission and will attach minutes reflecting the commission’s concerns about truck speeds and hours of operation.
