The special magistrate for the City of Oviedo ordered Park Place Apartments of Ovita LLC to either complete a permit application or remove outdoor seating from the property at 945 City Plaza by Nov. 13, 2025, at 5 p.m., or face fines of $100 a day.
Missy Acevedo, a code enforcement officer for the City of Oviedo, told the magistrate she first observed the unpermitted outdoor seating on May 14, 2025, after a complaint. Acevedo introduced a 23‑page packet of photos, notices and delivery affidavits she said documented notice to the property and subsequent extensions granted to allow the respondent to pursue planning approval. "This property was first observed in violation on 05/14/2025, where I received a complaint about outdoor seating with no permits," Acevedo said.
Acevedo said the city issued a notice of violation on May 15 and a corrected notice after an incorrect suite number, followed by a second notice on Aug. 21, 2025, with a corrective date of Sept. 3, 2025. She said the respondent contacted planning and was granted an extension but did not complete the required planning application. The magistrate found that notices required by Florida statute and Oviedo ordinance had been provided and that the respondent was aware of the problem.
The magistrate set a compliance deadline of Nov. 13, 2025, at 5 p.m. "By that time, they must have applied for a permit at the very least and be taking aggressive action to follow through to obtain the permit. If they do not do that, then they're going to have to either remove the outside seating or fines will accrue at the rate of $100 a day," the special magistrate said.
No additional speakers appeared to address the case at the hearing. The order requires either submission and progress toward permit approval or removal of the tables; the hearing record shows the city will begin assessing fines if the deadline is missed.
