Special Magistrate Kristen Ike found a Deltona homeowner in violation for performing exterior work without a permit at 2537 Newmark Drive and ordered the owner to obtain permits and complete any required corrections by Jan. 9, 2026.

Code compliance officer Enrique Rios said his inspection found an altered front face where a window’s dimensions changed and a door had been added. Rios said there was no permit or permit application on file; an NOV (notice of violation) had been issued after he made contact on Sept. 19. The corrective action listed on the file required obtaining a permit and meeting city ordinance requirements, including final inspection approval.

Homeowner Carlos Rodriguez told the magistrate he initially believed the work fell under an exception and did not need a permit, and he said the changes were made to address a leak. Rodriguez said he is considering restoring the opening to a previous configuration or converting it to a garage-door-sized opening and that he planned to do much of the work himself. He requested additional time because of work scheduling and the need for engineered drawings.

The magistrate noted engineered drawings may be required where a structural opening is altered and ruled that Jan. 9, 2026 is a reasonable compliance deadline. If the owner does not comply by 4:00 p.m. on that date, the magistrate ordered a $25-per-day fine until compliance. The owner must contact the code compliance inspector to verify compliance; the case file and related exhibits were admitted into the record.
