Sampling at 160 Bedford Street found arsenic in on‑site soils; the owner contracted disposal out of state and removal was scheduled for Jan. 16. The commission continued the item while enforcement, additional testing and a stormwater peer review proceed.
The Lakeville Conservation Commission on Jan. 14 received an update on enforcement and sampling at 160 Bedford Street after soil testing detected arsenic in at least one testpit. According to staff and the applicant’s consultants, the contaminated soil has been stored in lined containers on the site pending identification of an appropriate disposal facility; removal was scheduled to occur Jan. 16 to a facility in New York that would accept the material. The commission asked for certified documentation of the shipment and the receiving facility and continued the matter to Jan. 28.
Conservation staff said the original Notice of Intent for the project will require amendment to reflect revised stormwater controls informed by the testing results. The commission said it will seek a peer review (cost estimate to be obtained) focused on stormwater and remediation approaches to ensure that the revised plan will not exacerbate on‑ or off‑site water quality issues. Commission members also noted that planning and select board actions remain constrained while the site remains under enforcement for the fill and stockpile issues.
Commissioners voted to continue the item to the Jan. 28 meeting and requested certified manifest and disposal documentation once the material leaves the property.
