The Humboldt County Board of Supervisors recessed into closed session to discuss existing litigation involving the Potter Valley Hydroelectric Project (Federal Energy Regulatory Commission Project No. 77-285), County Counsel said, and later reported no reportable action.
County Counsel told the board the closed session was held pursuant to California Government Code section 54956.9(d)(1) to discuss the existing litigation over the Potter Valley Hydroelectric Project. "It is the intention of the board to meet in closed session pursuant to California government code section 54956.9 D1 in order to discuss existing litigation in the matter of the Potter Valley Hydroelectric Project, Federal Energy Regulatory Commission project number 77-285," County Counsel said during the meeting.
The meeting began with roll call and the Pledge of Allegiance. Supervisor Arroyo, Supervisor Bone, Supervisor McGram and Supervisor Wilson answered present after Chair Bushnell called the meeting to order and asked Nikki to conduct the roll call. County Counsel estimated the closed session would last about two hours and confirmed there were no public comments in the room or on Zoom before the board recessed.
After returning from closed session, County Counsel reported to the board: "There was no reportable action taken with regards to item C1." The board then adjourned.
No motions, votes or formal directives relating to the litigation were recorded in the public transcript; County Counsel’s statements are the only public disclosures about the closed-session item in the record.
