The Walton County Planning Commission voted to table rezoning case Z240067, a request to rezone 6.63 acres at 2435 Daniels Cemetery Road from A‑1 to A‑4 (business license) to allow show‑quality poultry, small parrots and related activity.
Applicant Igor Mitrovic told commissioners he is USDA‑licensed and inspected by the Georgia Department of Agriculture, and said his operation focuses on small parrots (cockatiels, green‑cheek conures and similar species) and small hobby poultry such as serama chickens. Mitrovic estimated about 800 birds in total across the site and said he has an avian veterinarian overseeing biosecurity; he described wire‑bottom cages, paper liners and dumpster disposal rather than litter and shavings.
Neighbor Robert Connerly testified in opposition, citing nighttime lighting from an open aviary structure and loud bird noise that, he said, reduced his property’s evening serenity: “I think they’re loud, I think they’re obnoxious. I think they ruin the serenity of being able to sit out at the campfire and enjoy the sunset, when all you hear is squawk, squawk.”
Mitrovic acknowledged the lights had been used during recent late work sessions and said he would phase out that behavior and plant screening (evergreens) between his bird structures and neighboring properties if requested. He also said geese on the property number 10 and are kept for grass and insect control.
During discussion commissioners and staff identified two procedural and compliance issues: the applicant’s most recent pole‑barn/aviary structure is closer to the side property line (Mitrovic estimated 15–20 feet) than county setbacks for the building type (50 feet), and commissioners wanted a clearer site plan showing the building location, proposed screening and potential mitigation measures. Commissioner Josh Ferguson proposed that the applicant discuss landscaping and screening with adjoining property owners. Commissioner Timothy Kemp moved to table the case to next month so the applicant and neighbors can meet and produce a site plan and any needed variance/mitigation documentation; the commission seconded and voted to table.
The commission asked the applicant to consult with planning staff about materials needed for the next hearing, including a scaled site plan and documentation of any variance requests needed for building setback compliance. The applicant said he intends no additional bird structures beyond the existing buildings and plans to add privacy evergreens behind the building line.
