The Lakeville Zoning Board of Appeals on Feb. 27 voted to grant a special permit authorizing additions to a preexisting nonconforming dwelling at 4 Marigold Lane, subject to a condition that the Board of Health receive a recorded two‑bedroom deed restriction before issuance of a building permit.
An attorney for the petitioner presented the application and told the board the lot is a preexisting nonconforming parcel with 9,787 square feet of area and existing frontage of 65.25 feet. The application proposes additions that would reduce the right‑side setback from the existing 26.5 feet to 10.6 feet and the front setback from 15.6 feet to 6.5 feet; the attorney noted the proposed front deck would not extend past an existing ledge that currently limits street clearance. The applicant also plans to remove some paved area at the rear and reconfigure parking to a two‑car driveway in front of the house.
The Board of Health submitted a memo noting the existing septic system is designed for a two‑bedroom dwelling and requiring a recorded two‑bedroom deed restriction; the board stated that if the deed restriction is recorded prior to the Board of Health hearing it will raise no objection. The fire chief provided a memo reminding the board that if renovation work exceeds 50% of the structure value the project must meet the current state building code for smoke and carbon monoxide alarms and expressing concerns about limited neighborhood access for emergency apparatus. The Planning Board also submitted comments raising concerns about access for fire apparatus, proximity to the neighboring dwelling at 2 Marigold Lane, and reduced parking access.
During the public comment period, neighbors voiced support. Pauline Robello of 3 Marigold Lane said she and her husband “are both supportive of this” and that the changes would “improve the neighborhood.” Alan Hoffman of 5 Marigold Lane said he supports the application and that the work would help his son remain in the house.
After discussion, a motion to approve the plans as submitted carried unanimously. The board recorded the only condition that the Board of Health receive the recorded two‑bedroom deed restriction prior to issuance of a building permit; the building permit will also be subject to compliance with state building‑code requirements cited by the fire chief. The board noted the usual administrative timeline: 14 days for paperwork to issue the decision and a 20‑day appeal period after recordation.
In other business the board voted unanimously to accept minutes from Dec. 9 and, on a separate motion, unanimously agreed to continue the hearing for the Residences at LaBaron Hills LLC to the board's April 17, 2025 meeting at the applicant's request; the applicant cited a peer review response and outstanding water‑connection issues that must be resolved with state and local agencies.
