The Malden Board of Appeal met Wednesday, April 16, 2025, opened a petition from Delight Medicals and voted to table the matter to the board's next regular meeting on May 21 because only three members were present.
The board’s chair said the panel had only three members in attendance and that the most efficient option was to open the hearing and immediately table it so the petitioner would not have to reapply and re-notify abutters. "So, we only have 3 members here tonight ... So the plan, tonight is to just open this up and then immediately table the meeting," the chair said.
Patrick McGovern, an attorney representing the petitioner Delight Medicals, told the board he had been advised earlier in the week that a full complement was unlikely and agreed that tabling to the next regularly scheduled meeting was reasonable. "It appears that there isn't even a quorum at this point," McGovern said.
After a motion by Member Froio and a second by Member King, the board voted to table the petition to the May 21 meeting. The motion carried on a voice vote with Members King, Froio and Kramer voting yes. The chair also noted the approval of minutes from the prior meeting would be deferred.
A petitioner or member of the public who asked about the substance of the appeal was told by the chair and by McGovern that the matter would not be heard that night but that McGovern could discuss details with them outside the public hearing. The transcript records an ambiguous reference to an address or case identifier that was not clearly stated on the record; the petition is identified in the hearing as filed by Delight Medicals.
The meeting adjourned at about 6:34 p.m. after a motion to adjourn by Member Froio, seconded by Member King and approved by voice vote.
