Applicant counsel Dwayne Dickerson told the commission the property is a 1923 plat with a 60‑foot lot width on its short side; current code requires a 100‑foot minimum lot width in the zoning district. Dickerson said the property’s historic platting and a city‑required five‑foot right‑of‑way dedication along Southeast Third Street together make it infeasible to meet the code’s 25‑foot required street‑side corner yard setback — the applicant asked to provide 20 feet instead.
Planning staff recommended approval. Commissioners noted the project’s scale is well under the zoning district’s maximum density; Dickerson said the three two‑story townhomes (about 1,800 square feet each) are a modest proposal and would include three garages and 360‑degree architecture approved by the Community Appearance Board and the Planning & Zoning Board.
The commission approved the site plan and the variances on a 5–0 vote (motion by Commissioner Hudak, second by Vice Mayor Preston). The commission then separately approved acceptance of a five‑foot right‑of‑way dedication along Southeast Third Street, also on a 5–0 roll‑call vote.
The clerk disclosed campaign contributions from the applicant’s representative earlier in the hearing. During the public hearing, a resident asked the commission to explain the hardship supporting the lot‑width variance; the applicant explained the combination of vintage plat dimensions and a required right‑of‑way dedication created the circumstances the variance addresses.
The approvals were conditioned on usual engineering, permitting and site requirements. The applicant waived formal quasi‑judicial procedures, and the project will move to final permitting and construction as conditions are satisfied.
