The Boone County Board approved Ordinance 25-11 on July 31, granting a special use permit to allow a dwelling as a lot-of-record exchange at 117X Shoal Road. County staff told the board the Zoning Board of Appeals had voted 5–0 to recommend approval and that the proposal satisfies the zoning code s applicable criteria.
Attorney Nathan Noble, representing the applicant, described the lot-of-record exchange as an ordinance mechanism that does not create a net increase in buildable lots. He said the exchange allows a house to be sited farther from adjacent properties while maintaining overall buildable-lot counts, and that the request fits the recently revised lot-of-record code language. Staff noted the dwelling will still require well and septic permits and a building permit before occupancy.
Board members who worked on the ordinance rewrite said the application met the six factors in section 2.73 of the county code and that the applicant had complied with the process. The board voted to approve the ordinance as recommended by staff and the zoning board.
