A Fort Bend County judge signed an order accepting the transfer of guardianship to the Texas Health and Human Services Commission (HHSC) for a client previously in CPS custody, the court said during a docket hearing.
Jennifer Gray, a legal guardian specialist with HHSC, testified the client (referred in May 2015) had diagnoses including ADHD, oppositional defiant disorder and intellectual disability, and required full guardianship. Gray told the court she was asked to approve the transfer after learning the client’s prior placement in Harris County had poor living conditions; the client was moved to a new, permanent placement in Fort Bend County.
The judge accepted the guardianship transfer, agreed to sign the order, and noted the court had removed designated 'DNR' language from the order; the parties may later seek modification of that language if appropriate. Gray told the court she might return later with a modification, but for now HHSC will serve as guardian under the accepted order.
Why it matters: The court’s acceptance of the transfer places responsibility for the ward’s care and decision-making with HHSC and confirms a permanent local placement, while the removal of DNR language indicates the court is reserving judgment on end-of-life or specific medical directives until further consideration.
