The York City Planning Commission recommended approval of a zoning variance Thursday that would allow 476 West Market Street to be used as a mixed commercial and residential building.
Staff presented case 27‑2025‑Z‑V and noted the property is in the UN‑2 urban residential neighborhood district. The application asked to permit an apartment combined with commercial use where the zoning code does not ordinarily allow that mix in the district; staff’s formal recommendation was denial but the commission moved to recommend approval.
Adam McAllister, the seller’s realtor, told the commission the property has functioned as commercial or mixed use for decades under prior carve‑outs on the block. He said the first floor has separate entrances and two half bathrooms and is already configured as office space, while the upstairs is a two‑bedroom apartment with separate egress and heating. Prospective buyer Maple Street Holdings, LLC, planned to locate a tax accounting office on the first floor and rent the second floor as a residential unit, McAllister said.
Commissioners discussed parking and access; the applicant said there is metered on‑street parking in front and space for approximately 10 vehicles at the rear of the property. After discussion the commission recommended approval of the variance by roll call.
Next steps: the recommendation will be forwarded to the Zoning Hearing Board and City Council as required for a use variance; building permits and inspections remain required for any changes.
