The Town of Babylon Zoning Board of Appeals reserved decision on an application to replace an above-ground pool with an in-ground pool in Lindenhurst after the board asked for an updated site plan showing additional pavers and confirmed pool orientation around low overhead wires.
The Town of Babylon Zoning Board of Appeals on Aug. 19 reserved decision on application 25127 from Keith and Patricia Cooney seeking permission to replace an above-ground pool with a conforming in-ground pool on a small Lindenhurst backyard.
The matter was put on the record by the applicants' attorney, Steve Bertolino, who said the proposal is not seeking setback relaxations but does request relief for lot coverage. Bertolino told the board the project replaces an earlier above-ground pool and that the new pool orientation was adjusted because “there are overhead wires ... those wires are quite low” and a midline splice influenced the layout.
The board questioned a difference between the submitted plot plan and the actual installation the applicant intends. Bertolino acknowledged the call on the application showed a 4-foot paved band around the pool but said the actual construction will include additional pavers connecting the deck staircase to the pool patio, which the plotted call did not show. The board asked for an updated site plan showing the connecting pavers and confirming that lot coverage calculations remain the same.
Chairman (unnamed) closed public comment and said the board would reserve decision and keep the record open pending submission of the revised plot plan. No formal vote on final approval was recorded at the hearing.
The board left conditions and planning recommendations to be addressed in its written decision once the updated documents are received.
