Troy City Council received a committee report recommending the city enter a subrecipient agreement with the Miami County Land Reutilization Corporation and a professional services agreement with Burgess & ****** Inc. to carry out Brownfield cleanup work at 1375 South Union Street.

The committee presentation said sampling and analysis, and voluntary action program phases 1 and 2 required by the U.S. Environmental Protection Agency would be included, and that the city would be reimbursed for eligible costs. The committee recommended authorizing the director of public service and safety to enter into a subrecipient agreement for $241,200 (including $4,000 in administrative costs) and a professional services agreement with Burgess not to exceed $237,200, and supported emergency legislation so work could proceed without delay.

Council did not adopt the item tonight. A council member asked that the resolution be scheduled for a second reading at the next meeting; council accepted that request and the item will return for a subsequent vote. No formal adoption or appropriation was recorded at this meeting.

The committee report noted the city expects to be reimbursed 100% of the project cost through the county subrecipient arrangement. Council members also noted that a professional services agreement had previously been awarded without council approval and that the director of law advised council approval is required.

Because the resolution was not adopted, staff were not authorized at this meeting to execute the subrecipient agreement or the professional services contract. Council indicated support for moving the item forward on a timeline that would allow work to begin as grant funds and contractual approvals permit.
