The commission received 23 notices regarding the zoning change, with no responses in favor or against from the community, including the Saint Leo's Neighborhood Association. City staff indicated that the proposed use aligns with the existing development pattern in the area, which includes various commercial and residential zoning districts. They found no evidence of likely adverse impacts on neighboring properties.
Max Moskovich, the property owner and applicant, explained that he and his wife moved to San Antonio to pursue their business dreams, including a law firm and a real estate brokerage. He clarified that they initially believed the property had pre-existing commercial use, but discovered that residential permits had been pulled, limiting their ability to rent to a commercial tenant. Moskovich emphasized the importance of maintaining some residential zoning to support future housing needs while accommodating the new retail use.
The conditional zoning will require a prescribed site plan, ensuring that any changes to the property undergo further public review. This decision reflects a balance between commercial development and residential preservation in a growing area of San Antonio.
