New York Courts Uphold FAPE for Special Education Students Until Age 22

Eastport-South Manor CSD is set to enhance educational opportunities for students with disabilities following a significant court ruling regarding the provision of Free and Appropriate Public Education (FAPE). During the Board of Education meeting on August 27, 2025, district officials discussed the implications of a recent appellate court decision that extends educational services for eligible students with disabilities until the day before their 22nd birthday.

Previously, New York State law mandated that students aged out of special education services at the end of the school year in which they turned 21. However, a landmark ruling from the appellate court has redefined this age limit, allowing students to receive services until just before their 22nd birthday. This change aligns with a similar ruling from Connecticut and aims to ensure that students with disabilities have access to necessary educational resources for a longer period.
