Officer Clover, one of the first responders, reported that upon arrival, he observed Saenz in a parking lot holding a metal object, later identified as a sword. Officer Clover deployed a 40 millimeter specialty impact weapon, designed for less lethal engagement, striking Saenz in the left leg in an attempt to deescalate the situation. Despite this, Saenz got back up and advanced toward the officers while brandishing the weapon, prompting Officers Romanski and Guerrero to retreat and subsequently discharge their firearms.

The investigation included interviews with several officers present at the scene. Officer Bullock corroborated Officer Clover's account, noting that Saenz was covered in blood and appeared to be swinging the metal object as he charged at the officers. Officer Dressler also confirmed the events, stating that he witnessed the officers retreating behind their vehicles as Saenz advanced, leading to the use of lethal force.
