Local resident faces citations for unauthorized go-kart track construction on private property

The Howard County Board of Appeals convened on June 5, 2025, to address a case involving Charles Siperko, who constructed a go-kart track on his property without obtaining the necessary permits. The meeting focused on the circumstances surrounding the construction and subsequent legal challenges.

Siperko explained that he built the track to provide his son, who aspires to be a professional driver, with a local practice area. He believed he was permitted to do so based on information he found on the county's website, which indicated that owning a go-kart was allowed on private property. He conducted searches for regulations regarding road use but found no relevant restrictions. Additionally, a paving company informed him that no permits were needed as long as the track did not connect to public roads.

However, the situation escalated when neighbors filed complaints with the Department of Planning and Zoning (DPZ). Inspectors visited the site during construction and later issued a notice of violation, stating that the track was not a permitted use. Siperko received citations for grading without a permit and for the unauthorized use of his property. He admitted to the grading violation in court, but the second charge regarding the use of the property was placed on an inactive docket pending the Board of Appeals' resolution.

During the meeting, Siperko's legal counsel noted that he opted to apply for a conditional use permit to address concerns from neighbors and to comply with legal precedents, including the Davis case. This decision was made to ease tensions and demonstrate a willingness to adhere to local regulations.

The Board of Appeals is expected to deliberate on the case further, considering the implications of Siperko's actions and the community's concerns regarding the use of residential properties for recreational activities. The outcome will determine whether Siperko can retain the go-kart track or if further legal action will be necessary.
