Wilmington Council debates ordinance for recreational marijuana zoning regulations

Wilmington's Community Development and Urban Planning Committee made headlines during their April 16 meeting by advancing a significant ordinance aimed at regulating recreational marijuana within the city. Sponsored by Council Member Johnson, the proposed legislation seeks to amend the city code to allow the cultivation, manufacturing, testing, and retail of recreational marijuana in designated commercial and waterfront zoning districts.

Council Member Johnson emphasized the importance of community input in shaping this ordinance, noting that it has been a hot topic in Delaware as the state navigates the new marijuana industry. The ordinance is designed to align with state laws that legalized recreational marijuana for adults aged 21 and over, while also imposing stricter local regulations to ensure public safety and community standards.

Gwen Kaminsky from the planning division presented the details, highlighting that the ordinance would establish specific zoning districts for marijuana operations, including buffer zones of 300 feet from residential areas and schools. This is crucial to prevent marijuana retail stores from being located in sensitive areas, which could impact neighborhoods and educational institutions.

The ordinance proposes that all four types of licensed marijuana uses be permitted in six districts, including heavy commercial and manufacturing zones, while retail operations would be allowed as a special exception in certain residential areas. Kaminsky pointed out that without these amendments, marijuana businesses could potentially set up shop in any area where similar uses are allowed, which could lead to unintended consequences.

The committee's discussions also touched on the need for parking regulations for new testing facilities, as well as the requirement for all marijuana businesses to obtain a city business license. This comprehensive approach aims to create a structured framework for the emerging industry while addressing community concerns.
