The Bay County Code Magistrate Hearing held on May 15, 2025, focused on ongoing violations related to a multifamily duplex structure that has faced significant damage and safety concerns since a tornado struck the area in January 2024.
The meeting began with a presentation of evidence regarding the property, which had been deemed unsafe by investigator Robert Clarkson during an inspection in April 2024. Photographs illustrating the damage were introduced as Exhibit A. Clarkson noted that the structure was in violation of Bay County code section 17-2 due to its unfit condition, including unauthorized repairs such as new stairs and railings added without the necessary permits.
Subsequent inspections revealed that the property remained in violation despite attempts by the owner, Miss Brown, to address the issues. A notice of violation was sent to her in September 2024, but certified mail was returned unclaimed, indicating difficulties in communication. By January 2025, Miss Brown reported that her Small Business Administration (SBA) loan had been approved, and she was in the process of securing an engineer and contractor for repairs.
During the April 1, 2025 inspection conducted by building inspector Scott Thorpe, further significant damage was documented. The structure, which was occupied at the time, showed extensive damage to the roof and rafters, with sagging and rotting components noted. Inspector Thorpe highlighted safety concerns, including insufficient gripping on handrails and unsecured sliding glass doors, which posed risks for occupants.
The hearing underscored the ongoing challenges in ensuring compliance with safety codes and the need for effective communication between property owners and code enforcement. The magistrate's decision on the case will determine the next steps for the property and its owner, as the situation continues to evolve.
