The upcoming May 2025 Town Meeting in Acton will feature a significant proposal aimed at amending the town's zoning bylaw concerning accessory dwelling units (ADUs). Article 30 seeks to align local regulations with the recently enacted Affordable Homes Act, which encourages the development of smaller, self-contained living units on properties with primary residences.
The proposed changes, which require a two-thirds majority vote, involve a comprehensive revision of existing zoning bylaws. Key amendments include limiting the number of ADUs to one per lot and establishing size restrictions based on the principal dwelling's gross floor area. Specifically, an ADU cannot exceed 50% of the principal unit's size or 900 square feet, whichever is smaller. However, existing basements that have been continuously used prior to May 6, 2025, will not face maximum size restrictions.
Additionally, the proposal allows for detached buildings, such as carriage houses, to serve as ADUs, provided they have existed since before April 2019 and do not undergo expansion. These detached units can have a maximum gross floor area of up to 2,000 square feet, excluding attic or basement spaces. For properties located outside a half-mile radius of a transit station, an extra parking space will be required for ADU residents.
The amendments also aim to eliminate barriers to ADU construction, such as design and parking requirements, and the need for owner occupancy. This flexibility is intended to support caregivers and individuals aging in place, while also promoting efficient land use in a tight housing market.
The proposed changes reflect a broader commitment to fair housing, as outlined in the 2020 housing production plan, which seeks to eliminate barriers for protected classes. By increasing the availability of accessible housing options, the town aims to address the growing demand from seniors and families with children.
