This clarification comes in response to delays in certification seen in eight states since November 2020, which have raised concerns about meeting local, state, and federal deadlines. The bill mandates that if an elections official fails to certify results on time, all election materials must be transferred to the Secretary of State to ensure timely certification.

The second focus of the bill is to combat misleading ballot return envelopes. Instances were reported where voters received unofficial envelopes that could confuse them, potentially jeopardizing their votes. AB 331 aims to classify the distribution of such fraudulent envelopes as a crime, thereby enhancing voter protection.

Lastly, the bill seeks to ensure that registered voters in county jails receive their voter information guides. Currently, many of these guides are not delivered due to jail policies against staples, which are used to bind the materials. AB 331 requires that these guides be provided in a format acceptable to jails, ensuring that incarcerated voters have access to essential voting information.

While the bill received support from the Attorney General's office, concerns were raised by the Secretary of State's office regarding the feasibility of certain provisions, particularly the potential requirement for the Secretary of State to take over the certification process if a county fails to do so. The Secretary's office highlighted logistical challenges, including the lack of necessary systems and trained staff to handle such responsibilities.
