Following an investigation, the commission found Capital in violation and approved a consent agreement imposing a civil penalty of $1,500, with $750 suspended for five years, contingent on no further violations.
Additionally, the commission reviewed a complaint from Enbridge against Arrow of North for failing to notify the North Dakota 1 Call notification center before beginning excavation work to repair a pipeline break. Arrow admitted to not contacting the center, leading to a civil penalty of $500, with $200 suspended under similar conditions as Capital's agreement.
Both cases highlight the importance of adhering to excavation regulations to prevent service disruptions and ensure public safety. The companies are required to remit their penalties within ten business days, reinforcing the commission's commitment to enforcing compliance in the industry.
