In a recent meeting of the Weyhem Zoning Board of Appeals, a public hearing was held to discuss a petition from Robert and Deborah Benson, residents of 64 Pilgrim Avenue, seeking a variance for a proposed screened porch on their existing deck. The hearing, scheduled for August 10, 2024, addressed the Bensons' request to enclose their deck, which has become increasingly uncomfortable due to excessive heat following the removal of nearby trees by a neighbor.
The Bensons explained that the deck, which faces south, has become nearly unusable due to the intense sun exposure, making it too hot to walk on barefoot. They emphasized that the addition of a roof would enhance their enjoyment of the space, which has been compromised since the removal of the trees that previously provided shade.
During the hearing, it was noted that the existing deck is approximately 7.5 to 8 feet from the property line, while the zoning requirement mandates a 10-foot setback. The Bensons are therefore requesting a variance of 3 to 3.5 feet. The board discussed whether the request would be detrimental to the neighborhood, with several neighbors voicing their support for the project. David Barty, an abutting neighbor, stated that the project would not disrupt the neighborhood and would enhance the utility of the Bensons' home.
After deliberation, the board unanimously approved the variance request, allowing the Bensons to proceed with their plans to improve their outdoor living space. The decision reflects a broader trend in local governance, where community input and support can significantly influence zoning decisions.
