In a recent government meeting, the Pearland City Council discussed a request from Nate Pierre to change the nonconforming status of a property located at 2223 North San Antonio Avenue. The request aims to allow the resumption of a previously abandoned three-family dwelling unit, which has been vacant for over six months.
Patrick Bauer, a staff member, presented the case, explaining that the property is currently classified under multifamily use but is situated in the Old Town Residential District, where such use is not permitted. The property was originally annexed into the city in 1959 and developed in 1983 under multifamily zoning. However, a zoning change in 2006 reclassified the area, prohibiting multifamily dwellings.
Bauer noted that the Unified Development Code requires properties with abandoned uses to either conform to permitted uses or seek a change in nonconforming status. He confirmed that the request met all criteria for approval, emphasizing that the applicant intends to resume the previous use without any intensification.
The council received one inquiry from a local property owner regarding the request, but no significant opposition was noted. The discussion highlighted the complexities of zoning regulations and the challenges faced by property owners in adapting to changing land use policies.
