The proposed site is located at 6841 South Yosemite Street, near East Arapahoe Road. This marks the first request for a wireless communications facility in five years, highlighting the growing demand for improved cellular coverage in the area.
During the city council meeting, planner Joe Peoria provided an overview of the regulatory framework governing wireless communications facilities, emphasizing that these structures are primarily regulated at the federal level by the Federal Communications Commission (FCC). The proposed facility is classified as a \"stealth\" structure, designed to blend into the environment, resembling an evergreen tree to minimize visual impact.
Peoria explained that while stealth facilities are generally permitted on non-residential properties, this particular request exceeds the maximum height allowed in the zoning district, necessitating a conditional use approval from the city council. The site is currently occupied by an older office building and is situated in an area designated for two to three-story buildings, making the proposed height of 50 feet notably taller than the existing structures.
The council must evaluate the application against six criteria to determine its appropriateness. These criteria include compatibility with surrounding land uses, the necessity of the facility to address coverage gaps, and the potential impact on the natural environment. Staff findings indicated that the proposed facility would enhance cell service in an area identified as having significant coverage gaps, thus supporting the city's comprehensive plan.
Council members raised questions regarding the conditional nature of the approval and the recourse available to residents who may oppose the facility. Peoria clarified that the council's authority is limited to the height of the structure, and once approved, the facility would be subject to administrative review for compliance with all other regulations.
