In a recent government meeting, the appeal for the Interfor Digital Valley Data Center was a focal point of discussion, led by Cameron Heimer from development services. The appeal, submitted by Harvey Fitzgerald of Interstate Engineering, sought to overturn a previous decision denying the application for a Conditional Use Permit (CUP) due to non-compliance with setback requirements outlined in the county's data center ordinance.
Heimer explained that during a review of the proposed site in Drive Fork Township, staff identified that the property did not meet the required setback from sensitive properties, specifically nearby homes. Although the area is designated as an employment zone for commercial and industrial growth in the Williams County comprehensive plan, the ordinance mandates strict adherence to setback regulations, which ultimately led to the denial of the application.
Fitzgerald argued in favor of the site, highlighting its advantages, including proximity to a substation, access via a paved road, and existing heavy industrial zoning. He noted that the site had already been graded, which would reduce the impact on local infrastructure by minimizing the need for additional material transport.
The county commission now faces the decision of whether to approve the appeal, which would allow the project to proceed to a public hearing for further consideration. If approved, the project would still require public input before any final decisions are made. The outcome of this appeal could significantly impact the future of industrial development in the area.
