In a recent government meeting, officials discussed a request for the approval of a lot split involving an 8.5-acre property located at the southwest corner of Adams Boulevard and Bison Road, currently owned by Legacy Church of Christ. The proposal, submitted by Craig Demuth, aims to divide the land into two lots: a 2.06-acre lot with an existing single-family residence and a larger 6.44-acre lot intended for potential future development.
The planning commission reviewed the request, noting that both proposed lots meet the bulk and area requirements for the RS 7 single-family residential zoning. However, the subdivision regulations stipulate that any lot split resulting in at least one lot smaller than 10 acres must be officially plotted as a subdivision. The commission has the authority to waive this requirement if it does not impair the purposes of plotting.
Key considerations included the need for right-of-way dedication. Staff recommended a 60-foot dedication for Bison Road, while for Adams Boulevard, a 45-foot dedication was suggested to avoid encroachment issues with the existing residence. The existing home would be classified as lawful non-conforming, allowing for maintenance but not replacement in its current location if it were to be completely destroyed.
Future development on either lot would require compliance with current regulations, including the installation of a fire hydrant and sidewalk along Bison Road. Currently, city sewer service is unavailable, but both lots can utilize private septic systems until city services are extended.
The commission expressed confidence that the proposed conditions would not impair planning purposes and recommended approval of the lot split, contingent upon the necessary right-of-way and utility easement dedications. The meeting concluded with an acknowledgment that any future subdivision of the property would require adherence to city regulations.
