Key findings from their research highlighted that while hate speech is generally protected under the First Amendment, it can only be criminalized if it incites imminent violence or consists of specific threats. The council clarified that public comment periods are considered limited public forums, allowing for reasonable regulations regarding the time, place, and manner of speech.
The updated policies, adopted on August 6, include streamlined public comment procedures, which now require individuals to sign up in advance to speak, either in person or remotely. Each speaker is allotted three minutes, with a total public comment period capped at 30 minutes, extendable at the presiding officer's discretion. Additionally, written comments must be submitted two hours prior to meetings.
The council also introduced guidelines for addressing problematic comments. After a speaker's time has expired, council members can make a general statement about the nature of the comments, emphasizing community values and correcting misinformation without engaging directly with the speaker.
Prohibited behaviors during public comment include disruptions such as clapping or booing, and specific threats of violence. The council aims to foster a constructive dialogue while ensuring that all voices can be heard in a respectful manner.
