The case, involving respondents Michael G. Pizzarelli and Mikhail V. Pizzarelli, was initiated following an inspection on March 26, 2024, which revealed multiple violations of city codes.

The violations included obstructions in exterior property areas and issues related to restoration and stabilization, as outlined in sections 4108H1 and 56.25 B of the Port CMC code. A notice of violation was issued on May 17, 2024, granting the respondents until June 19, 2024, to rectify the issues. However, compliance was not achieved by the deadline, prompting a notice of hearing sent via certified mail on August 5, 2024.

Officer Herzog confirmed that proper service was achieved on August 8, 2024. He requested that the respondents be ordered to comply with the city code by October 9, 2024. Should they fail to do so, they would face a daily fine of $50 for each day the violation persists, up to a maximum of $5,000. Additionally, the city has incurred costs of $411 related to the investigation, which would also be due if compliance is not met by the specified date. The meeting included visual evidence of the property in question, underscoring the seriousness of the violations.
