In a recent government meeting, the Board of Zoning Appeals reviewed a variance request for a front yard setback on a corner lot located at the intersection of Fairdale Road and Village Lane. The property, which houses a townhome built in 1993, is part of the Village Place Townhomes Edition and features an irregularly shaped lot measuring approximately 68.88 feet in width and 105.56 feet in depth.
The applicant, represented by contractor Zach Prester, submitted a building permit application on June 10, 2024, seeking to construct a 12-foot by 17-foot sunroom addition on the southwest corner of the dwelling. However, planning staff determined that the proposed addition would not comply with the zoning ordinance, which mandates a 25-foot front yard setback for corner lots. The sunroom was found to extend approximately 9 feet into this required setback, resulting in a proposed setback of about 16 feet from the property line along Fairdale Road.
The applicant subsequently filed for a variance on September 10, 2024, to allow the construction of the sunroom in its proposed location. Notably, a 1995 text amendment reduced the required front yard setback for corner lots to 20 feet; however, this amendment does not apply to the applicant's property, as it was platted before the change.
The Board of Zoning Appeals is now tasked with evaluating the variance request against specific criteria to determine if it meets the necessary conditions for approval. The surrounding area consists of similar townhome developments, which may influence the board's decision regarding the request.
